The Sponsor reserves the right to contact Competitors for verification purposes and administration of a Competition. As a condition of participating, each Competitor consents to such verification and agrees to reasonably cooperate in good faith with the Sponsor throughout the duration of the Competition. 

Notification is deemed to have occurred immediately upon sending of an email, timestamp of a voice message, or confirmation of receipt from delivery service. In addition, a potential winner’s name and their city and state/jurisdiction or other general information may be posted on the Sponsor’s social media account, provided on a winner’s list, or elsewhere publicly at Sponsor’s sole discretion. Prize or prize elements will only be mailed, where applicable, to the winner’s address within an eligible state. If any prize, prize notification, or Competition-related communication is rejected, faulty, or undeliverable; if the potential winner does not respond according to the notification or Sponsor’s instructions; or if a winner or a potential winner fails to comply with these Rules: the prize may, at Sponsor’s sole discretion, be forfeited (regardless of whether the potential winner has been announced anywhere) and an alternate winner may be determined (if possible and time permitting) or the prize may be unable to be awarded based on the nature of the Competition. Unawarded prizes will be dealt with by the Sponsor, at its sole discretion, to the extent permitted by applicable law. The Sponsor reserves the right to modify the notification procedures and applicable deadlines for responding in connection with the selection of any alternate potential winner, if any. If a prize is legitimately claimed, it will be awarded. Upon prize forfeiture or inability to use a prize or portion thereof, no compensation will be given, and Sponsor will have no responsibility or liability to that Competitor. To claim a prize, the winner must follow the directions in their notification. Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify at any time any potential winner who does not meet the eligibility criteria described above or has otherwise violated these Rules, even if the potential winner has been notified or announced publicly or otherwise that they may have or did win a prize. 

Winner documents are each subject to verification by Sponsor and may require the Competitor to provide their taxpayer identification number (e.g., Social Security Number) and/or a copy of government-issued identification card or number (e.g., drivers license number, passport number). In addition, Tax forms (e.g. U.S. Federal IRS 1099-MISC) may (in Sponsor’s sole discretion) be submitted to applicable authorities on the prize recipient’s behalf by the Sponsor for the actual value of the prize awarded. 

All the Treasure Riddle Packages are subject to the Sponsor’s terms and conditions. The Sponsor is not responsible for the failure of the event to occur as scheduled for any reason. The Sponsor is not responsible for inability to attend the event or other inability to use any entry or other tickets or prize elements, in which case the tickets or prize is forfeited, and we will provide no substitution.

Stated prize value is as of date of posting these Rules. All prize details not specifically stated in these Rules will be determined by the Sponsor at its sole discretion. Certain restrictions apply. The Sponsor is not responsible for and will not replace any lost, mutilated, or stolen prize, or any prize that is undeliverable or does not reach a winner because of incorrect or changed contact information. No transfers, prize substitutions, or cash redemptions will be made, except at the Sponsor’s sole discretion. No more than the state prizes will be awarded. Competitors waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize, and any liability and publicity which might arise from claiming or seeking to claim said prize.

NOTHING IN THESE RULES LIMITS, EXCLUDES, MODIFIES OR PURPORTS TO LIMIT, EXCLUDE OR MODIFY ANY STATUTORY CONSUMER GUARANTEES OR ANY IMPLIED CONDITION OR WARRANTY THE EXCLUSION OF WHICH FROM THESE TERMS AND CONDITIONS WOULD CONTRAVENE ANY STATUTE OR CAUSE ANY PART OF THESE TERMS AND CONDITIONS TO BE VOID (“NON-EXCLUDABLE GUARANTEES”). THE LIMITATIONS IN THIS CLAUSE ARE SUBJECT TO THE NON-EXCLUDABLE GUARANTEES. 

EACH COMPETITOR AGREES (AND AGREES TO CONFIRM IN WRITING) TO THE MAXIMUM EXTENT PERMITTED BY LAW, TO RELEASE, HOLD HARMLESS, AND INDEMNIFY SPONSOR FROM AND AGAINST ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, USE, MISUSE, OR AWARDING OF THE PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY PRIZE- OR COMPETITION-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, LOSS, DEATH OR ACCIDENT TO PERSON OR PROPERTY. WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, THE WINNER AGREES THAT SPONSOR IS NOT RESPONSIBLE IN ANY WAY FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY. 

BY PARTICIPATING, YOU HEREBY WAIVE (TO THE EXTENT ALLOWED BY APPLICABLE LAW) ALL RIGHTS TO CLAIM DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, AND CONSEQUENTIAL DAMAGES AND/OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. YOU ACKNOWLEDGE AND AGREE THAT, WITH RESPECT TO ANY CLAIM BY YOU RELATING TO OR ARISING OUT OF SPONSOR’S ACTUAL OR ALLEGED EXPLOITATION OR USE OF ANY COMPETITOR’S NAME, LIKENESS, OR OTHER INFORMATION SUBMITTED OR ACTIVITY PERFORMED IN CONNECTION WITH THE COMPETITION, THE DAMAGE, IF ANY, CAUSED TO YOU WILL NOT BE IRREPARABLE OR OTHERWISE SUFFICIENT TO ENTITLE YOU TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF OR IN ANY WAY ENJOIN THE PRODUCTION, DISTRIBUTION, EXHIBITION, OR OTHER EXPLOITATION OF ANY SPONSOR PROPERTY, PROMOTION, OR PRODUCTION, AND YOUR RIGHTS AND REMEDIES IN ANY SUCH EVENT ARE STRICTLY LIMITED TO THE RIGHT TO RECOVER DAMAGES, IF ANY, IN AN ACTION AT LAW. 

Sponsor is not responsible and/or liable for any of the following, whether caused by Sponsor, the Competitor, or by human error: participation submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected entries, email, mail, or Competition-related correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Rules, in any Competition-related advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or entry information. Sponsor is not responsible for electronic communications that are undeliverable or do not reach the Competitor as a result of any form of active or passive filtering of any kind of insufficient space in a potential winner’s e-mail or voice mail inbox. The Sponsor is not responsible, and may disqualify you, if your email address or other contact information does not work or is changed without prior written notice to the Sponsor. Without limiting any other provision in these Rules, Sponsor is not responsible or liable to any Competitor or winner or any person claiming through such Competitor or winner for failure to supply the prize or any part thereof in the event that any of the Competition activities or Sponsor’ operations or activities are affected, as determined by Sponsor in its sole discretion, including, without limitation, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, pandemic, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any law, rule, regulation, order or other action adopted or taken by any governmental authority, or any other cause, whether or not specifically mentioned above.
